4.2 Aviation Legislation
4.2.2 Describe the requirements to hold an aviation document, as laid down in the CA Act 2023, sections 55 and 78.
55 Rules relating to aviation documents
The Minister may make rules requiring aviation documents for:
- New Zealand registered aircraft
- Aerodromes
- Aeronautical products
- Aviation participants
- For a pilot, the aviation document is their pilot licence and any associated ratings or medical certificate requirements.
The rules must state:
- The requirements for each aviation document
- The standards that must be met
- The application procedures
- The maximum period the document may be issued for
The Minister may also make rules stating that some types of aviation document do not need to meet certain fit and proper person requirements.
78 Duration and conditions of aviation document
The Director may issue an aviation document:
- For a specified period of time
- Subject to any conditions the Director considers appropriate
If a person is affected by a decision made under this section, they may:
- Appeal the decision to the District Court
4.2.4 Describe the criteria for the fit and proper person test, as laid down in the CA Act 2023, section 80.
