4.32 General Operating Restrictions

4.32.2 State the restrictions on smoking in an aircraft. CA Act 2023, section 402

402 No smoking

A person must not smoke or vape on an aircraft when smoking or vaping is not permitted.

 

Smoking or vaping is not allowed:

  • when a crew member instructs a person not to smoke or vape

  • when passenger information signs or placards say smoking or vaping is not permitted

  • on any aircraft carrying passengers for hire or reward on an internal flight

  • on any aircraft operated by a New Zealand international airline carrying passengers on any route

 

Meaning of smoking

For this rule, smoking includes:

  • smoking an ignited product, weed, or plant

  • holding or having control of an ignited product, weed, or plant

  • vaping

 

Offence and penalties

A person who breaches this rule commits an infringement offence.

They may be liable for:

  • an infringement fee of $500, or

  • a court fine of up to $2,500

 

 

4.32.4 State the restrictions associated with the abuse of drugs and alcohol. CAR Part 91, rule 91.118.

91.118 Intoxicating liquor and drugs

A crew member must not act in their official capacity if they are affected by alcohol or drugs.
