4.4 Definitions
CAR Part 1 (unless otherwise noted)
State the definition of:
(a) accident;
An accident is an occurrence associated with the operation of an aircraft.
For an aircraft carrying people, it applies from the time a person boards the aircraft with the intention of flight until:
- Everyone on board has disembarked
- The engine, propeller, or rotor has come to rest
For an aircraft flown without people on board, it applies from the time the aircraft is ready to move for flight until:
- The aircraft comes to rest at the end of the flight
- The primary propulsion system is shut down
An occurrence is an accident if:
- A person is fatally or seriously injured
- The aircraft suffers damage or structural failure
- The aircraft is missing
- The aircraft is completely inaccessible
A fatal or serious injury counts as an accident if it results from:
- Being in the aircraft
- Direct contact with any part of the aircraft
- Direct contact with a part that has detached from the aircraft
- Direct exposure to jet blast
